Reglas Oficiales del Programa Mobile 2008

COMPRA NO ES NECESARIA. UNA COMPRA O PAGO DE CUALQUER COSA NO AUMENTARÁ SU PROBABILIDAD DE GANAR.

1. Elegibilidad: La campaña de America On the Move Programa Mobile 2008 (la “promoción”) esta abierta solamente a residentes legales de los cincuenta (50) estados Unidos y el Distrito de Columbia y que tienen por lo menos diez y ocho (18) anos de edad cuando se registraron a la promoción. Empleados de la America On the Move Foundation, inc. (AOMF) y su compañía principal y sus afiliaciones, suministradores como también familia inmediata (esposos, padres, hermanos e hijos) y miembros del hogar de cada uno de esos empleados no son elegibles. Sujeto a todo lo aplicable a las leyes y reglas federales, estatales y locales. Inválido donde es prohibido. Participación constituye acuerdo completo y sin condición de parte de los participantes a estas Reglas Oficiales y decisiones de AOMF, las cuales son finales y ligadas en todos los asuntos relacionados a la Promoción. El ganar un premio depende al llenar todos los requisitos que se han puesto de aquí en adelante. La Promoción consiste de un sorteo (the Sweepstakes) con un ganador a un premio mayor que será determinado por rifa al azar al concluir la Promoción del Programa Mobil.

2. Tiempo: La Promoción comienza el 17 de Agosto de 2008 a las 12:00 del medio día del tiempo Este (“ET) y termina el 9 de Noviembre de 2008 a las 11:59 PM ET ( el “Período de la Promoción”) La computadora de AOMF es el guardador oficial del aparato del tiempo para esta Promoción.

3. Como Participar: Durante el Periodo de la Promoción, use su teléfono celular y escriba el mensaje de texto uno del los seis (6) códigos siguientes ( AOMA, AOMB, AOMC, AOMH, AOML, o AOMP) al 50555 o vaya a http://www.americaonthemove.org/mobile y llene y remita el formulario de registración por el Internet de Steptember. Usted automáticamente recibirá una (1) entrada a la rifa. Entradas múltiples no son permitidas compartir la misma dirección de correo electrónico. Cualquier intento de algún participante de obtener mas de las entradas permitidas al usar múltiple/ diferentes direcciones correo electrónico, diferentes identidades, registraciones o cualquier otro método, anulará las entradas del participante y ese participante puede ser descalificado. El uso de cualquier sistema automático para participar es prohibido y resultará en descalificación. AOMF no es responsable por registraciones perdidas, tardadas, inválidas o ininteligibles o con dirección equivocada, las cuales serán descalificadas. En el evento de una disputa a cualquier registración, la persona autorizada a la cuenta del correo electrónico usada para registrarse será considerada ser el registrante. La “Persona Autorizada a la Cuenta” es la persona natural asignada a un correo electrónico por un proveedor del Internet, Proveedor por la red electrónica u otra organización responsable de asignar direcciones de correo electrónico para propiedad asociada con la dirección remitida. El posible ganador pueda que le sea requerido mostrar prueba de ser el dueño de la cuenta autorizada.

4. Sorteo: AOMF seleccionará al azar el posible ganador de todas las entradas elegibles el o acerca del 21 de Diciembre de2008.

5. TODOS LOS POSIBLES GANADORES SERAN SUJETOS A VERIFICACION POR AOMF. CUAL DECISIONES SON FINALES Y LIGADAS EN TODOS LOS ASUNSTOS RELACIONADOS CON ESTA PROMOCION. UN PARTICIPANTE NO ES UN GANADOR DE ALGUN PREMIO, AUN CUANDO EL SORTEO LO INDIQUE, AL MENOS QUE Y HASTA QUE LA ELEGIBILIDAD DEL PARTICIPANTE, Y EL POSIBLE GANADOR DEL SORTEO HAYA SIDO VERIFICADO Y EL PARTICIPANTE HAYA SIDO NOTIFICADO QUE LA VERIFICACION ESTA COMPLETA.

6. Verificación del Posible Ganador: Posible Ganadores debe de continuar a cumplir todos los términos y condiciones de estas Reglas Oficiales, y el ganar depende de llenar todos esto requisitos . El posible ganador del Sorteo será notificado por correo electrónico después de la fecha de la rifa al azar. El posible ganador del Premio Mayor(padre/guardián legal si el ganador es un menor de edad en el estado donde el/ella reside) será requerido que firme y envíe a AOMF, dentro de diez (10) días de la fecha que la notificación fue enviada, una Declaración de Elegibilidad, Responsabilidad y Permiso de Publicidad (con excepción donde es prohibido) para reclamar su premio si es aplicable. Si un ganador potencial de cualquier premio no puede ser contactado, o falla a firmar y enviar la Declaración de Elegibilidad, Responsabilidad y Permiso de Publicidad dentro el periodo de tiempo requerido (si es aplicable), el posible ganador pierde el derecho al premio. En el evento que un posible ganador de un premio es descalificado por alguna razón, AOMF otorgará el premio aplicable a un ganador suplente al rifar al azar entre todos los participantes elegibles restantes. Habrán tres (3) rifas suplentes después de que el premio no sea otorgado. Premios serán dados de 8 a 10 semanas después que la Promoción haya terminado.

7. Premio del Sorteo: UN (1) PREMIO MAYOR (a) Una Tarjeta de Regalo de $1, 000 redimible en una cadena de supermercados. Términos y condiciones serán aplicadas en la tarjeta de regalo. (b) Una tarjeta de Regalo de $500 redimible en una cadena de tiendas deportivas. Términos y condiciones serán aplicadas a la tarjeta de regalo. (c) Por lo menos tres sesiones (las cuales serán a través de una combinación de correo electrónico y teléfono) con una dietista registrada seleccionada por AOMF(cada sesión será de un minino de 30 minutos, pero no mas de 10 horas en total para todas las sesiones combinadas) con un valor Aproximado de $1000. La probabilidad de ganar el Premio del Sorteo depende en el número de entradas elegibles recibidas durante el Periodo de Promoción. No será dado dinero en efectivo equivalente y todos los premios no son transferibles y sustitución no será hecha , excepto como es provisto de aquí en adelante a la sola discreción de AOMF. AOMF reserva el derecho de sustituir cualquier de los premios por un valor igual o mayor si el premio designado no esta disponible por alguna razón. El ganador es responsable por todos los impuestos y costos asociados con el premio recibido y /o usado. TOTAL DE TODOS LOS PROMIOS: $2,500.00.

8. Renuncia y Liberación : Al recibir cualquier premio, el ganador acuerda el liberar y mantiene inocente a AOMF y sus subsidiarios, afiliados, suministradores, distribuidores, agencias de promoción y publicidad y cada uno de sus respectivas compañías principales y cada oficial, directores empleado y agentes de cada compañía (colectivamente los “grupos liberados”) de cualquier reclamo, causa o acción, incluyendo, pero no limitado a perjuicio, muerte, o daño a o pérdida de propiedad, que resulte de la participación en la Promoción o recibo o uso o mal uso de cualquier premio.

9. Publicidad: Excepto donde es prohibido, participación en la Promoción constituye el consentimiento del ganador a AOMF el usar el nombre del ganador, parecido, fotografía, voz, opiniones y/o cuidad y estado para propósitos promocionales en cualquier medio de publicidad , mundial, sin consideración o pago futuro.

10. Condiciones Generales: AOMF reserva el derecho de cancelar, suspender y/o modificar la Promoción, o cualquier parte de ella. Si cualquier fraude, fallo técnico o cualquier otro factor fuera del control razonable de AOMF, perjudica la integridad o funcionamiento apropiado del Sorteo, como determinado por AOMF en su sola discreción. En ese evento, AOM reserva el derecho de otorgar el premio al azar entre las entradas elegibles recibidas hasta el tiempo del perjuicio. AOM reserva el derecho, en su sola discreción, a descalificar entradas recibidas de cualquier individuo que encuentre alterando con el proceso de entrada o la operación del sorteo o actuando en violación de estas Reglas Oficiales o cualquier otra promoción o en una manera grosera o disruptiva. Cualquier intento de alguna persona a deliberadamente debilitar la legitimación de la operación del Sorteo puede ser una violación criminal y de ley civil, y, si ese intento es hecho, AOMF reserva el derecho de buscar prosecución de daños de cualquier de esas personas al extenso permitido por la ley. La falta de AOMF de cumplir con cualquier termino de estas Reglas Oficiales no debería de constituir una renuncia a esta cláusula.

Official Rules Mobile Program 2008

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility: America On the Move's 2008 Mobile Program campaign (the "Promotion") is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees of the America On the Move Foundation, Inc. (AOMF), and their parent and affiliate companies, suppliers as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Subject to all applicable federal, state and local laws and regulations. ShowPopUp where prohibited. Participation constitutes entrant's full and unconditional agreement to these Official Rules and AOMF's decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Promotion consists of a Sweepstakes (the "Sweepstakes") with a grand prize winner to be determined by random drawing at the conclusion of the Mobile Program Promotion.

2. Timing: The Promotion begins on August 17, 2008 at 12:00 am Eastern Time (“ET”) and ends on November 9, 2008 at 11:59 pm ET (the “Promotion Period”). AOMF's computer is the official time-keeping device for this Promotion.

3. How to Enter: During the Promotion Period, use your cell phone to text one of the following six (6) codes (AOMA, AOMB, AOMC, AOMH, AOML or AOMP) to 50555 or go to http://www.americaonthemove.org/mobile and fill out and submit the online Steptember registration form. You will automatically receive one (1) entry into the Sweepstakes. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will ShowPopUp that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. AOMF is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.

4. Sweepstakes: AOMF will randomly select the potential Sweepstakes winner from all eligible entries on or around December 21, 2008.

5. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY AOMF, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE SWEEPSTAKES SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT'S ELIGIBILITY, AND THE POTENTIAL SWEEPSTAKES WINNER HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

6. Verification of Potential Winner: Potential winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. The potential Sweepstakes winner will be notified by email after the date of random drawing. The potential Grand Prize winner (parent/legal guardian if winner is a minor in his/her state of residence) will be required to sign and return to AOMF, within ten (10) days of the date notice is sent, an Affidavit of Eligibility, Liability and Publicity Release (except where prohibited) in order to claim his/her prize if applicable. If a potential winner of any prize cannot be contacted, or fails to sign and return the Affidavit of Eligibility, Liability and Publicity Release within the required time period (if applicable), the potential winner forfeits the prize. In the event that a potential winner of a prize is disqualified for any reason, AOMF will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. There will be three (3) alternate drawings after which the prize will remain unawarded. Prizes will be fulfilled 8-10 weeks after the conclusion of the Promotion.

7. Sweepstakes Prize: ONE (1) GRAND PRIZE: (a) A $1,000 Gift Card redeemable at a grocery chain. Terms and conditions will apply on gift card. (b) A $500 Gift Card redeemable at a sporting goods chain. Terms and conditions will apply on gift card. (c),At least three sessions (which shall be through a combination of e-mail and telephone) with a registered dietician selected by AOMF (each session to be a minimum of 30 minutes, but no more than 10 hours total for all of the sessions combined) with an Approximate Retail Value (“ARV”) of $1000. Odds of winning the Sweepstakes Prize depend on the number of eligible entries received during the Promotion Period. No cash equivalent and all prizes are non-transferable and no substitution will be made except as provided herein at AOMF's sole discretion. AOMF reserves the right to substitute any listed prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. TOTAL ARV OF ALL PRIZES: $2,500.00.

8. Release: By receipt of any prize, winner agrees to release and hold harmless AOMF and its respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize.

9. Publicity: Except where prohibited, participation in the Promotion constitutes winner's consent to AOMF's use of winner's name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

10. General Conditions: AOMF reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond AOMF's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by AOMF in its sole discretion. In such event, AOM reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment. AOM reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, AOMF reserves the right to seek damages from any such person to the fullest extent permitted by law. AOMF's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
